Article 1 - Presentation of the website

Article 2 - Applicability and enforceability of these GTC to the Client

All orders placed on our Site are subject to these general terms and conditions of sale (hereinafter, the "GTCS").

You declare that you are a natural person, at least 18 years old and have the legal capacity or parental authorisation to place an order on our Site (hereinafter "the Customer" or "You").

The present GTC will be enforceable against you as soon as you have acknowledged, by ticking a box provided for this purpose, that you are aware of them.

It is not technically possible to place an order without checking this box.

In view of possible changes to the Site, we reserve the right to adapt or modify these GTC at any time. Consequently, we invite you to consult our GTC before placing any new order.


Article 3 - Products

Each product offered on the site is accompanied by a descriptive text and one or more photos enabling you to know the essential characteristics of the product before placing your final order, in accordance with the provisions of article L.111-1 of the French Consumer Code.

There may be slight differences between a product and its photograph, depending on the resolution and colour definition of your monitor.

The products we sell comply with the regulations in force relating to personal safety and health, fair trading and consumer protection at the time they are placed on the market.

Our products are offered while stocks last.

If the product is unavailable, we will inform you by email; you will then be reimbursed and the order cancelled.

For all hat orders that are unavailable at the time of your order, we will inform you by email of the additional lead time. You will then be able to receive your order with an extended lead time (2 to 3 weeks) or a refund with order cancellation, if the lead time is not suitable.

No compensation for cancellation (apart from a full refund of the order) can be claimed.


Article 4 - Creation of a customer account

To place an order on our site, we recommend that you create a customer account (which will allow you to access your latest orders and manage your returns).

To create your account, you will be asked to enter your full name, your e-mail address and to choose a password.

After creating your customer account, you will receive a confirmation e-mail.

You agree to provide accurate and up-to-date information.

Access to your account is protected by a password, which you undertake to keep confidential.

If you become aware of any fraudulent use of your account, please report it to us immediately.


Article 5 - Order formation process

In order to place an order, you will need to fill in your "shopping cart" with the products you have selected and the quantities you wish to order, and then click on " payment ". You will then be asked to fill in the information required for delivery, as well as those relating to your payment method.

Before confirming your order, you will have the opportunity to check the details of your order and its total price, and to return to the previous pages to correct any errors or modify your order.

By confirming the order, you agree to these GTC, which form the contract between you and us.  

An e-mail summarising your order will be sent to you as soon as possible after its confirmation.


Article 6 - Sale price and payment

6.1 The prices mentioned on our site are indicated in euros, inclusive of all taxes and exclusive of delivery and transport costs, for each of the products listed for sale on the site and before final validation of the order.

The total amount of your order, including shipping costs, will be shown on the order confirmation page.

The price is due immediately, the validation of your order being conditional upon the simultaneous payment of its price.

We reserve the right to change our prices at any time, but of course we guarantee that the price in effect at the time of your order will apply.  

We inform you that in the event of an incorrect price being displayed, for whatever reason, the order - even if validated by us - will be cancelled, and we will inform you of this as soon as possible.

6.2 Payment is made, at your choice:

Or through the Paypal payment service, provided you have a Paypal account (6.2.2.);

Or, if you wish to pay in instalments, via the Klarna payment service (6.2.3.)

6.2.1. We take all necessary steps to ensure the confidentiality and security of bank details transmitted to our site.

Our site is equipped with a secure online payment system that encrypts your bank details.

Payment information is transmitted according to the highest security standards.

The transmission of your bank details is guaranteed by our partner Mollie. 

All information exchanged to process the payment is encrypted using the 3D Secure security system.

This data cannot be detected, intercepted or used by third parties.

At no time does the Customer's financial data pass through the La Cerise sur le Chapeau computer system.

6.2.2. Paypal (Europe) SARL et Cie, is a Luxembourg limited partnership with shares, registered with the R.C.S. of Luxembourg under the number B118349, whose registered office is located at 22-24, Boulevard Royal - L-2449 Luxembourg.

PayPal is duly authorised in Luxembourg as a credit institution.

The data provided to Paypal does not pass through our computer system.

Article 7 - Delivery and deadlines

Delivery is handled by independent service providers such as Colissimo.

We shall not be liable for any delay in delivery for any reason whatsoever.

If you wish, it is also possible to collect your order directly from our shop, during opening hours, at 44 rue du cherche-midi 75006 Paris.


Article 8 - Right of withdrawal

You have the right to withdraw from this contract without giving any reason within fourteen days, except for custom-made and personalised hats (such as embroidery).

The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last item included in your order.

In order for the withdrawal period to be observed, it is sufficient for you to send your communication on the exercise of the right of withdrawal before the withdrawal period expires.

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for any additional costs arising from the fact that you have chosen a delivery method other than the cheaper standard delivery method offered by us) without undue delay and in any event no later than fourteen days from the day we are informed of your decision to withdraw from this contract.

We will refund you using the same payment method you used for the original transaction, unless you expressly agree to a different method, and in any event there will be no charge to you for this refund.

We may defer the refund until we have received the goods or you have provided proof of shipment of the goods, whichever is earlier.

You must return the goods to us without undue delay and, in any event, no later than fourteen days after receiving or making available your package. This deadline is deemed to have been met if you return the goods before the fourteen day deadline has expired. 

You will have to pay the direct costs of returning the goods

You are only liable for the depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.

Article 9 - Exchanges 

 We do not offer standard exchanges on our site. For a different size, a new model or a different color, simply reorder.

Please note that any payment made with a gift card or credit note will result in the creation of a credit note.

Article 10 - Returns

Our almost-perfects, Happy Endings and Braderie are neither returned nor exchanged.
You may return any item that does not suit you within 15 days of receipt of your parcel. To ensure that your order is returned in the best possible conditions, we invite you to contact our customer service department [email protected] quoting your order number.

Remember to keep the original box to ensure that your return package is properly packed. All items worn, damaged and/or without original labels cannot be returned. Returns are at the customer's expense.


Article 11 - Customs duties

Any order placed on the site and delivered outside of France may be subject to possible taxes and customs duties that are imposed when the package reaches its destination.

These customs duties and taxes, if any, related to the delivery of an item are the responsibility of the customer.


Article 12 - Intellectual property

The elements reproduced on the Site, which are the exclusive property of the publisher, are protected by copyright, trademark law and patent law.

Any reproduction and dissemination of these elements, without prior written permission from the publisher, will expose the offenders to legal proceedings.
